Presentation Of Evidence In International Commercial Arbitration:
A Comparative Study

Prakash Narayanan & Raghubir Menon*

In international commercial arbitration, problems often arise with regard to the method of presenting evidence. Presentation of evidence is both a part of substantive and procedural law. The rules of arbitration formulated by various institutions have deal with presentation of evidence. Therefore, a comparison of the various rules of procedure would assist parties in determining which set of rules to adopt. However, since these rules do not comprehensively cover all aspects of presentation of evidence, an examination of the substantive law is required to ascertain whether the gaps can be filled.
